This is an agreement describing the terms and conditions for participation in the WebSupergoo Free License Scheme.

The terms "you", and "your" refer to you the applicant. The terms "we", "us" and "our" refer to WebSupergoo.

Both parties are independent contractors and this agreement shall not constitute a partnership, joint venture, or other similar relationship.

Offer

We offer you the opportunity to obtain one single installation license for selected items of software ("the software") in return for publishing an endorsement with associated promotional text and images ("the article").

We reserve the right to accept or reject applications as we see fit.

We do not expect you to - and you agree not to - apply for any refund on the basis that you intend to replace a purchased license with a license obtained under this agreement.

You must maintain the article. You must ensure these are both visible and usable by people visiting your website. You must not move the article or degrade access to it. You must provide an obvious way for visitors to get to our website using the article.

Term

This agreement will begin on our acceptance of your application and will remain in full force and effect for as long as the software is in use or for a minimum period of six months whichever is the greater.

You can prematurely terminate this agreement by purchasing a full license for the software using the purchase page of our web site (http://www.websupergoo.com/).

We reserve the right to prematurely terminate this agreement without prior notice in our sole discretion for reasons including, without limitation, failure to abide by the spirit of the accord.

Marketing

As part of this agreement we grant you a limited right to extract copyrighted material from our web site for the purpose of creating the article.

We require that you represent yourself, our services and our products accurately and fairly. As such we may request changes and if these changes are not made we may terminate this agreement.

On termination of this agreement you must remove, delete or otherwise destroy any content you have copied from this web site and any content (including license keys) which may have been provided to you under this agreement.

Liability

Under no circumstances shall we be liable for any loss, injury or damage of whatever nature arising in connection with the agreement, our services or our products, even if we have been advised of the possibility of such damages.

We make no warranties with respect to this agreement, our services or our products. We hereby expressly disclaim all implied warranties including warranties of merchantability or fitness for a particular use or purpose.

Law

English law shall govern this agreement. Any action relating to this agreement must be brought in courts located in London (England), and you irrevocably consent to the jurisdiction of these courts.

If any part of this agreement is found void and unenforceable, it shall not affect the validity of the balance of the agreement, which shall remain valid and enforceable according to its terms.

Acceptance

By submitting this form, you acknowledge that you have read and understood the agreement and agree to all its terms and conditions. You furthermore acknowledge that you have the authority to enter into this agreement on behalf of your organization.

Please ensure that you fill out all the fields on this form correctly.

Please do not apply on behalf of clients. If your client wishes to take advantage of our offers they must apply themselves. They can then pass any license information to you for use on their site.

You should allow at least five working days for your application to be processed. It is important that the details you provide are correct. If any of them need modification, your application will need to be re-submitted which will mean another delay of five working days. We do not expedite applications.

All applications are manually checked and verified. Please do not make applications unless you have put in place the required article. Incorrect applications will be rejected. If you have a query about an application please email us - do not send messages using this form.
